Accommodation Booking Terms and Conditions

§ 1 Subject of the Terms and Conditions

These Terms and Conditions apply to all persons staying on the premises of Kashubian Lodge & Spa located in Częstocin, municipality of Przywidz.

The Terms and Conditions define the rules for the provision of services, the scope of responsibilities of Guests and the Lodge, and the rules of staying on the hotel premises.

Confirmation of having read and accepted these Terms and Conditions takes place at the moment of making a reservation, paying a deposit, paying the full amount for the stay, or signing the registration card.

§ 2 Hotel Day

Rooms are rented on a daily basis. The hotel day lasts from 4:00 PM to 11:00 AM the following day.

The room may not be transferred or made available to third parties, even if the paid rental period has not yet expired.

§ 3 Reservation and Registration

Reservations may be made by email or by completing the form available at [www.kashubian.pl](http://www.kashubian.pl).

By making a reservation, the Guest consents to the processing of their personal data by Kashubian Karolina Rendaszka, registered in Gdynia, ul. 3 Maja 37A lok. 12, 81-396 Gdynia, NIP: 5861118792; REGON: 191608609, in accordance with the Act of 29 August 1997 on Personal Data Protection, for purposes related to the transaction.

The owner of the Lodge is Kashubian Karolina Rendaszka, registered in Gdynia, ul. 3 Maja 37A lok. 12, 81-396 Gdynia, NIP: 5861118792; REGON: 191608609.

After making a reservation, the Guest receives a reservation confirmation, which must be referenced when making any changes.

Reservations are made in the name of a natural person or business entity responsible for payment.

Making a reservation constitutes confirmation that the reserving party accepts these Terms and Conditions.

A reservation is considered confirmed upon payment of the agreed deposit amounting to 50% of the total stay price to the Lodge’s bank account or via online payment through the booking module available at [www.kashubian.pl](http://www.kashubian.pl).

Failure to pay the deposit within the agreed time automatically cancels the reservation.

The deposit must be paid within 3 days from the date of reservation confirmation sent by email.

The deposit paid in accordance with the above rules is non-refundable unless the cancellation occurs no later than 30 days before the planned arrival date. In such case, the full deposit will be refunded using the same payment method used in the original transaction, unless expressly agreed otherwise. No additional fees will be charged in connection with the refund.

If the deposit has been paid and the Guest fails to arrive by 6:00 AM on the following day (arrival on the second day) without prior written or email notification to [info@kashubian.pl](mailto:info@kashubian.pl), this shall be considered a cancellation of the stay.

§ 4 Lodge Liability

The Lodge is liable only for items deposited for safekeeping. In other cases involving loss or damage to items brought by Guests, the provisions of the Civil Code shall apply.

The Lodge reserves the right to refuse acceptance of items of high value, significant amounts of cash, items posing safety risks, and large items that cannot be stored in the deposit.

The Lodge is not liable for damage to or loss of cars or other vehicles belonging to Guests parked in the unguarded parking area. The Lodge is also not responsible for items left inside parked vehicles.

§ 5 Guest Responsibility

Children under the age of 12 must remain under the constant supervision of their legal guardians while on the Lodge premises. Legal guardians are financially responsible for any damage caused by children.

Guests and persons using the Lodge services must not disturb the peaceful stay of other Guests. In case of violation, the Lodge may refuse to continue providing services to the person concerned.

Any damage occurring on the premises must be immediately reported to the reception.

The Guest bears full financial responsibility for any damage or destruction of equipment or technical devices caused by the Guest or their visitors.

§ 6 Complaints

Guests have the right to file complaints if deficiencies in service quality are observed. Complaints should be submitted immediately after noticing the issue.

Written complaints are accepted at the hotel reception.

Complaints will be considered promptly upon receipt, no later than 14 days from the date of submission. In disputed matters, the provisions of the Civil Code shall apply.

§ 7 Personal Data Information

The controller of your personal data is Kashubian Karolina Rendaszka, registered in Gdynia, ul. 3 Maja 37A lok. 12, 81-396 Gdynia, NIP: 5861118792; REGON: 191608609.

The Guest’s personal data is processed based on the service agreement concluded between the Guest and the Lodge. The purpose of data processing is the provision of hotel or similar services requested by the Guest.

Additionally, personal data may be processed through video monitoring used on the premises. The purpose of video monitoring is to ensure the safety of Guests and other persons staying on or around the premises.

If the Guest provides personal data concerning stay preferences or requested services, the Lodge may process this data to improve service quality, ensure Guest comfort, provide additional services, and conduct satisfaction surveys solely in connection with the continuous improvement of services. The legal basis for such processing is the legitimate interest of the Lodge (Article 6(1)(f) of the GDPR).

Providing personal data necessary for Guest identification is both a contractual and statutory requirement (for issuing a VAT invoice). Failure to provide personal data makes it impossible to conclude a contract with the Lodge and to issue a VAT invoice.

Each Guest has the right to access their personal data, rectify and update it, transfer data, object to processing, restrict processing, and request deletion of personal data where legally justified.

Personal data will be stored for the duration of service provision and for the limitation period of potential claims, including tax and civil claims. Video monitoring data will be stored for 14 days.

Personal data will not be subject to automated decision-making, including profiling.

Personal data may be disclosed only in accordance with applicable law.

Guests have the right to lodge a complaint with the supervisory authority responsible for personal data protection, i.e., the President of the Personal Data Protection Office in Warsaw, ul. Stawki 2.
